Amiad Kushner leads Seiden Law’s litigation practice as a Partner and the firm’s Head of Litigation, drawing on more than twenty years trying and arguing high-stakes commercial cases, international arbitrations, and appeals across the United States, Asia, and Europe. Before joining the firm he practiced at Simpson Thacher & Bartlett and Lowenstein Sandler, and he has built a record of consequential cross-border results, including a landmark ruling that a cryptocurrency exchange may be held liable for aiding and abetting a terrorist attack and a $475 million arbitration award for a Chinese insurer.

Anti-Terrorism & Digital Assets

  • Binance / October 7 (S.D.N.Y.). Representing U.S. nationals against Binance Holdings Ltd. and its founder Changpeng Zhao for allegedly facilitating the October 7 terrorist attacks; argued and defeated the defendants’ motion to dismiss, producing a landmark ruling that a cryptocurrency exchange may be held liable for aiding and abetting a terrorist attack.

Trials & International Arbitration

  • $475 Million Hong Kong Arbitration. Won a $475 million award on behalf of a Chinese insurer as co-lead trial counsel after an eight-day trial.
  • $360 Million Bench Trial. Co-lead trial counsel at a New York state bench trial relating to a disputed $360 million transaction, resulting in a liability ruling for the firm’s client.
  • $100 Million+ Jury Trial. Co-lead trial counsel at a two-week New York state jury trial against London insurers involving over $100 million in claims.
  • $130 Million+ Hong Kong Arbitration. Lead trial counsel in a Hong Kong arbitration involving over $130 million in claims; the tribunal ruled for the client on claims for abetting breaches of fiduciary duty.

Enforcement & Appeals

  • Vacatur for Fraud: First of Its Kind. Obtained a New York order vacating an international arbitration award against a Chinese client on grounds of fraud, recognized as the first ruling of its kind.
  • $450 Million Award Enforcement. Represented the respondent in S.D.N.Y. and Second Circuit enforcement proceedings related to a $450 million international arbitral award.
  • Fourth Circuit Appeal. Secured a Maryland district court judgment confirming Hong Kong arbitral awards and successfully argued the Fourth Circuit appeal affirming the judgment.

Investor & Fiduciary Disputes

  • Hanfor Fraud. Representing Chinese investors in New York state court seeking over $50 million in connection with the Hanfor asset-management fraud.
  • Shanghai Construction Group. Representing U.S. subsidiaries of Shanghai Construction Group in New York litigation related to real-estate projects.
  • Israeli Trustee: Chapter 15. Represented an Israeli trustee in a Chapter 15 case in New York bankruptcy court arising from a $100 million Ponzi scheme.
  • Fir Tree / CIG Wireless. Represented Fir Tree Partners and former directors of CIG Wireless in Florida shareholder litigation involving a $143 million merger.
  • Madoff Clawback Defense. Represented an Asian government pension fund in defense of over $40 million in clawback claims related to the Madoff fraud.
