Overview
Thomas Mott is an experienced litigator. With over a decade of experience representing clients in U.S. federal and state courts at the highest levels of complex commercial litigation matters, he helps clients of Seiden Law achieve maximum results in a multitude of commercial disputes.
Mr. Mott previously worked for two large New York law firms in the litigation group handling matters involving banks, insurers, hedge funds, private equity firms in a broad range of cases concerning contracts, shareholders’ rights, activist investor campaigns, breaches of fiduciary duty, business torts (including fraud and unfair competition), bankruptcy, trusts and estates, cross-border issues, complex financial products, securities, commercial leases, federal regulators, insurance coverage, employment issues, voting rights, software implementations, and defamation.
Mr. Mott is a graduate of Georgetown University Law Center and Cornell University.
Engagements
- Represented minority shareholder of large privately held food company in action asserting rights to an additional 50% stake in the company.
- Represented activist investor hedge fund in its dispute with large technology company regarding its adoption of preclusive advance notice bylaws.
- Represented hedge funds in dispute over the validity of the funds’ purchases of large stakes in a regional bank.
- Represented certain objecting parties in Puerto Rico’s municipal bankruptcy proceedings with respect to more than $20 billion in claims against multiple Puerto Rico entities.
- Represented large Chinese bank in quashing subpoenas and asset freeze orders in enforcement action seeking to collect on a $1.8 billion counterfeiting judgment.
- Represented real estate investors in dispute over ballooning construction costs of a large public project.
- Defended several private equity funds and hedge funds in action alleging their receipt of redemption proceeds were fraudulent transfers.
- Represented a large international manufacturer in an action alleging fraud and breach of contract stemming from an implementation of enterprise resource planning software.
- Represented a large company in an action against an activist group that had engaged in an aggressive social media campaign targeting the company’s customers and business partners.
- Represented hedge funds and institutional investors in several actions collectively seeking billions of dollars from investment banks sponsoring mortgage-backed securitizations.
- Represented large international developmental bank in connection with a series of litigations against major investment banks and other financial institutions concerning billions of dollars of collateralized debt obligations.
